Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Proxifai platform and services (the "Service"). This AUP is incorporated into and forms part of our Terms of Service. Violation of this AUP may result in suspension or termination of your account.

1. General Principles

You agree to use the Service responsibly and in compliance with all applicable laws and regulations. You are responsible for all activity under your account, including actions taken by AI agents operating on your behalf and all code executed through the Service.

2. Prohibited Activities

You may not use the Service to:

2.1 Illegal and Harmful Content

  • Generate, store, distribute, or facilitate any content that is illegal under applicable law
  • Create or distribute child sexual abuse material (CSAM) or any content that exploits or harms minors
  • Generate or distribute content that promotes terrorism, violent extremism, or incites violence
  • Create, store, or distribute malware, ransomware, viruses, trojans, or other malicious code
  • Generate content that constitutes hate speech, harassment, threats, or doxxing
  • Create non-consensual intimate imagery or deepfakes
  • Distribute defamatory, libelous, or fraudulent content
  • Generate or distribute intentional disinformation or deceptive content designed to mislead

2.2 Security Violations

  • Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks — whether through the platform directly or through code executed on the platform
  • Probe, scan, or test the vulnerability of the Service or any connected system without written authorization
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Launch denial-of-service (DoS/DDoS) attacks against the Service or any other target
  • Bypass, circumvent, or attempt to circumvent any security measures, authentication mechanisms, or access controls
  • Use the Service to attack, compromise, or exploit vulnerabilities in third-party systems
  • Use AI agents or executed code to gain unauthorized access to external systems, databases, or services
  • Deploy agents that attempt to escalate privileges, exfiltrate data, or perform lateral movement within any network
  • Execute code designed to intercept, monitor, or capture data or traffic without proper authorization

2.3 Intellectual Property Infringement

  • Infringe upon any third-party intellectual property rights, including copyrights, trademarks, patents, or trade secrets
  • Use AI agents to systematically reproduce, scrape, or mirror copyrighted content
  • Create pirated software, crack license protections, or generate tools to circumvent digital rights management (DRM)
  • Use the Service to generate code that you know infringes on existing patents or proprietary software

2.4 Spam and Abuse

  • Send unsolicited messages, bulk emails, or spam through or using the Service
  • Create fake accounts, impersonate others, or misrepresent your identity or affiliation
  • Use the Service for phishing, social engineering, or fraudulent schemes
  • Manipulate or artificially inflate metrics, usage statistics, or reviews
  • Deploy agents that send unsolicited communications or interact with third-party services in a deceptive manner

2.5 Resource Abuse

  • Use AI agents for cryptocurrency mining, blockchain validation, or similar compute-intensive activities unrelated to software development
  • Intentionally consume excessive resources to degrade the Service for other users
  • Use the Service as a general-purpose compute platform for workloads unrelated to its intended purpose
  • Circumvent usage limits, quotas, or rate limits through technical means or multiple accounts
  • Resell, sublicense, or redistribute the Service or its compute resources without written authorization

2.6 Regulated and High-Risk Uses

  • Use AI-generated code in safety-critical systems (medical devices, aviation controls, nuclear systems, autonomous vehicles) without appropriate human review and regulatory compliance
  • Process protected health information (PHI) unless a Business Associate Agreement is in place
  • Process payment card data in violation of PCI DSS requirements
  • Use the Service in any manner that violates export control laws or sanctions regulations
  • Deploy AI agents for automated decision-making that produces legal or similarly significant effects on individuals (employment, credit, housing, education, insurance, healthcare, law enforcement, immigration, government benefits) without implementing qualified human oversight and all safeguards required by applicable law
  • Use AI agents as a sole or primary basis for consequential decisions affecting individuals' rights, access to services, or legal status without meaningful human review

2.7 EU AI Act Prohibited Practices

In accordance with the EU Artificial Intelligence Act (Regulation 2024/1689) Article 5, the following uses are strictly prohibited regardless of jurisdiction:

  • Social scoring: AI systems that evaluate or classify individuals based on their social behavior or personal characteristics, leading to detrimental or unfavorable treatment unrelated to the context of original data collection
  • Manipulative or deceptive AI: AI systems that deploy subliminal, manipulative, or deceptive techniques to materially distort behavior or impair informed decision-making, causing or likely to cause significant harm
  • Exploitation of vulnerabilities: AI systems that exploit vulnerabilities of individuals or groups due to age, disability, or social or economic situation to materially distort their behavior
  • Real-time remote biometric identification: AI systems for real-time remote biometric identification in publicly accessible spaces for law enforcement purposes, unless specifically authorized under applicable law
  • Emotion recognition in restricted contexts: AI systems for emotion recognition in workplace or educational settings, unless for medical or safety purposes as permitted by law
  • Biometric categorization: AI systems that categorize individuals based on biometric data to infer sensitive attributes such as race, political opinions, religious beliefs, or sexual orientation
  • Facial image scraping: AI systems that create or expand facial recognition databases through untargeted scraping of facial images from the internet or CCTV footage
  • Predictive policing (individual): AI systems for making individual risk assessments of natural persons to predict criminal offenses based solely on profiling or personality traits

2.8 Autonomous Agent Restrictions

When deploying AI agents through the Service, you must additionally ensure that agents do not:

  • Take irreversible real-world actions (financial transactions, sending communications, deleting data, modifying production systems) without explicit human authorization for each such action, unless you have implemented appropriate safeguards and accept full responsibility
  • Interact with third-party systems, APIs, or services in a manner that violates those services' terms of use
  • Autonomously create accounts, register for services, or enter into agreements on behalf of any person or entity without proper authorization
  • Conceal or misrepresent their nature as AI systems when interacting with humans or third-party services that reasonably expect human interaction
  • Attempt to circumvent safety filters, content policies, or usage restrictions of any AI model provider or third-party service
  • Execute code or take actions designed to compromise, destabilize, or gain unauthorized access to the Proxifai platform, other users' environments, or any external system
  • Autonomously replicate, self-modify in uncontrolled ways, or acquire resources beyond those explicitly allocated
  • Operate weapons systems or make lethal targeting decisions without meaningful human control

2.9 Code Execution Restrictions

When executing arbitrary code through the Service, you must ensure that:

  • All code you submit for execution is lawful in your jurisdiction and all jurisdictions where it produces effects
  • Code does not attempt to escape, breach, or circumvent the sandbox or isolation environment
  • Code does not attempt to access, read, modify, or exfiltrate data belonging to other users or tenants
  • Code does not consume resources in a manner designed to degrade service for other users
  • Code does not establish persistent unauthorized access channels (backdoors, reverse shells, C2 infrastructure) to external systems
  • Code does not violate any applicable export control, sanctions, or trade compliance regulations

3. Your Responsibilities

  • Code Review: You are responsible for reviewing all AI-generated code before deployment to production environments
  • Security: You must maintain the security of your account credentials and API keys. Report any unauthorized access immediately
  • Compliance: You must ensure that your use of the Service complies with all applicable laws in your jurisdiction, including AI-specific regulations (EU AI Act, Colorado AI Act, Texas TRAIGA, California SB 53, and other state or national AI laws)
  • Third-Party Rights: You must ensure that your use of the Service does not violate the rights of any third party
  • Agent Supervision: You are responsible for monitoring the output and actions of AI agents operating under your account. You must be able to halt agent operations at any time
  • AI Transparency: Where required by law, you must disclose to end users that they are interacting with or affected by AI systems
  • Risk Assessment: For high-risk deployments, you must conduct and document appropriate risk assessments before using the Service, in accordance with applicable regulations (including CCPA/CPRA risk assessments, Colorado AI Act impact assessments, and EU AI Act conformity assessments where applicable)
  • Record Keeping: Where required by applicable law (including the EU AI Act), you must retain logs of AI agent operations for at least 6 months, or longer as mandated by your applicable regulations

4. Enforcement

We reserve the right to investigate and take action against any violations of this AUP, including but not limited to:

  • Warning: Notifying you of the violation and requesting corrective action
  • Content Removal: Removing or disabling access to content that violates this AUP
  • Agent Termination: Immediately halting the execution of AI agents or code that violates this AUP or poses a risk to the Service or third parties
  • Account Suspension: Temporarily suspending your account and access to the Service
  • Account Termination: Permanently terminating your account
  • Legal Action: Pursuing legal remedies where appropriate

For severe violations (such as CSAM, malware distribution, active attacks on our infrastructure, or EU AI Act prohibited practices), we may terminate your account immediately without prior warning.

We may also report illegal activities to appropriate law enforcement authorities as required or permitted by law. Where required by the Digital Services Act, we will provide statements of reasons for content moderation decisions.

5. Reporting Violations and Illegal Content

If you become aware of any violation of this AUP, or if you believe that content hosted on or generated through the Service is illegal, please report it to us at [email protected]. We take all reports seriously and will investigate promptly.

In accordance with the EU Digital Services Act (Regulation 2022/2065), reports of illegal content from users in the European Union will be processed in compliance with DSA requirements. We will acknowledge receipt of such reports and inform you of the outcome of our investigation and any action taken.

6. Changes to This Policy

We may update this AUP from time to time to reflect changes in law, regulation, or industry practice. We will notify you of material changes by posting the updated policy on our website and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated AUP.
